If the judge does grant me full custody, can I decline child support from my wife? I dont want any money or nothing from her because she is already going to have it bad enough. I only want her to be in my daughter life that is it. im sorry bro, i too have been going thru the same sort of thing, only we didnt get married the judge will almost NEVER grant full custody to either parent unless intended custodial parent is proven to be; negligable to children, financially insecure and on their own, and drug problems (there are others but not as likely) most of the time is 51/49%, the parent with 51% gets support and residential rights. The crazy thing about child separation is it really us up to the judge and how they feel that day. U could agree to have ur child every other week and have no money exchanged and thats techincally 50/50, but it has to be agreed upon by both lawyers and parents, and i think every year you have to renew ur contract (since thats what child support is, a legally binding contract)..... so its really up to how convincing the parents are to the judge of their wishes be strong, its not suppose to be easy, otherwise it wouldnt feel so rewarding to raise a child have ur court dates in the early morning, and never fight in court or argue a thing... If you're entitled to support, take it.
