i have state farm also and he better be prepaired for his rates to at least DOUBLE. my wife got in to a accident and only caused 2k damage to the other car and are insurance doubled so i cant fathom how much his will go up

He will be liable for any medical bills. She can try to sue in civil court but will have to prove anything she is looking for is due to the accident. Sounds like it happened at a very low speed. Her being on the windshield is a good thing, under a car is the worst. From a criminal standpoint he is GTG. From a civil side she can try to sue but wont get very far. Make sure the police report is very detailed and also the witnesses statement. If the witness didn't make one you better find them and have them do so.

So when the police officers came, they took stories from both of us. My friend did not get written up for anything AT THE MOMENT right now, but he has to get a phone call from the police station with information stating how the woman is doing, what the hospital reports say, etc. At this moment, he has 0 citations and we only know the age of the woman, (no name / address). He was going to stop by in person and apologize and explain his side of the story, but we don't have any of that information yet.

The accident happened around 4-7mph. Im guessing on the lower side beacuse the way she landed on the windshield, it wasn't a hard impact. Sort of like a "roll" on the windshield then a "roll" onto the ground.

When it comes to medical bills, his insurance company says they will deal with that? I jsut said his insurance is probably going to sky rocket, but idk. Hes trippin out thinknigs hes gonna get finicially sued for life or get locked up for manslaughter. (but she is alive so idk how that wil happen)

Manslaughter is a criminal offense. tell your friend to chill the fuck out, he did nothing criminal.

The fact that that no citation was given at the time is bullshit as the ladies condition has nothing to do with the traffic laws that were broken. If I were him I'd call and ask flat out am I being cited or not. But he's in chicken shit phase so he wont.

Again, from a criminal standpoint he did nothing wrong. It wasn't intentional and it doesn't sound like any bodily harm occurred. In Indiana he would still be on the hook for the traffic ticket(s) for failure to yield and whatever else the officer is gonna write him for. On the civil side anyone can sue for just about anything. Doesn't mean they will get it just means they can. At the end of the day it will be fine, his rates will most likely go up but he wont be in any real financial trouble. Courts are getting tired of ambulance chasers, trust me.

Just so you know, it doesn't matter if she acts fine at the scene. Adrenaline will keep her moving around for awhile and the actual swelling muscle problems might not happen til later on. Best bet is to see what a doctor says then go from there.

The crazy thing too is when I ran out to ask her if she was okay or if I needed to do anything serious like carry her to the car and SPEED to the hospital, she kept stating to us and the cops she couldn't get up. After every question the police officers ask, she would say (she couldn't speak good english, but still understandable), "I cant get up, I cant get up." It got to the ponit where they had to carry her and put her on a stretcher. The thing was, when I ran out there before the police officers came, she stood up and then when I asked her if she was okay, she like "fell" dont on the curb and started to immediately say "I can't get up". Too me, that looks like a way she can say she hurt her "hip" or something and sue. but then again, Idk the sueing laws.

AND TO ROLEX AGAIN, The witness who was in our favor (Said he did a compelte stop, etc) is actually a lawyer I think. He handed us all his bussiness cards and things of that nature.

i hate to say this but i have had many family members who have gotten in to accidents with people who could not speak english and every one of them (even the one that hit me from behind) tryed to sue us. thank god none where able to go through tho.

I just read what your statement about the hip and her falling. If she sues the Dr.'s notes and treatment will determine what she gets from the insurance company. She can still try and sue him as an individual but if she accepts a settlement from the insurance company, if that happens, the courts will generally toss out the individual lawsuit.

And FYI.... we have SF and my wife smoked a deer this past summer. $9K in damage. my insurance went up $3 a month

I paid out the person I hit from my bank account. I didn't use insurance to pay because of how much the rates would go up. I was fortunate the person I hit was a straight up dude and just wanted his hospital bills paid. He even used his own personal insurance and I just paid his deductibles. He showed me all the bills. If she does sue, your friend better hope his bodily damage amount on the insurance covers it or he will come out of pocket.

If your boy has SF let them earn their monthly premium and do all the work. They, SF and all insurance co., are in the business not to pay out. If he gets any calls from anyone, simply direct them to SF if he cant deal with it.

I got a friend now that just filed bankruptcy because of an accident he had and his dumbass didn't have insurance. He was sued for like 50,000 because he smashed a lexus and hurt some people in it. He lost and said fuck it. I felt bad for the people he was in the accident with because they didn't get shit from him.

Hire a lawyer or if you have a good one call him and ask him. Better safe then sorry
