Unless you can prove they were presenting an immediate threat, you can't do anything. If they are running away and are outside of your house when you shoot them...its still murder. It would indicate them running or fleeing, trying to escape. Therefore they couldn't possess an immediate threat. If the wound is inflicted in the ventricular area of the body, it can be self defense. Bassless once again.
