You should do 2 things. 1) File the kidnapping report with the local police department with as much detail as possible. That way she only has 2 modes of recourse, either come back on her own, or have the honor of having the U.S. Marshalls service escort her back (kidnapping with transportation across state lines is a Federal offense). 2) You need to call you county attouneys office. They will be the one handeling the criminal case, plus should be able to guide you on how to procede.

EDIT: Another thing to do: Start looking for victom/Advocate groupe geared towards Father in you situation. They should be a wealth of information and support, and alot (generally) have ties to pro bono attouneys.

If they arent married, and she is the birith mom, and no sort of custody arrangements have been made yet, there aint shit he can do because it is NOT at this point kidnapping. Not good advice in this scenario. What you say would apply if HE had custody of the child and she only had visitation rights and then took off with the kid. Filing a kidnapping report with the local PD at this point would essentially be filing a false police report( birth mother cannot kidnap her own child, based on the specifics of this particular case). The cops in his area dont/ wont get involved because she isnt breaking any laws at the moment. Not to mention out of their jurisdiction.

Even though she is the mom she can't take the child across state borders with out his permission. My mom and biological dad weren't together and whenever she wanted to go out of state she had to get signed permission from him. She had full physical custody and he only had visitation rights.

Its also realty state based on what the police can do, if they legally don't have laws against her taking their child across state borders there is nothing they can do.

Just file for custody and push for a court date ASAP. If she doesn't show up with the child she can be court ordered to come back. Also while in court ask the judge that it be mandatory for her to stay in the state until custody has been established

thanks guys. i called the police and they are not to helpfull at this point. i called the police in georgia where she went and they need papers from the police department here and the police department here said they cant do anything over there. its a big mess right now. i have messages from her from a couple months ago stating that she was going to sign custody over to me and see him whenever i let her.. i know how her family is and i know they forced her to go to georgia. she callled me earlier today because the police officer told me to email her and ask if she will give me her adress so we can get custody sorted out and when i talked to her i heard her mom telling her what to say in the background. my sons mom has no backbone i swear she does whatever her mom tells her to wich is really sad cause my sons mom is 22 years old. ud think she wuld make her own decisions. then i sent her a email telling her not to call me on the phone that if she has anything to say to send it to me via email that i do not want any phone conversations going on. i also told the police i wanted to file child kidnapping and they said its not child kidnapping since its the mother its child stealing (idk what the difference is it sounds the same to me) also he said that they cant do anything at this point cause its only been a week and she hasnt shown any signs of taking him from me forever. like she moved across the country what more proof do you need!? im going back to the family court tomorrow to see what i can do.

You need to find out what the time period is to establish residency where she is now. Once she's been there long enough to establish residency (or in some states gets a dl or id card for that state) then you can try to get her on parental kidnapping. Until then the cops will not do anything because she isn't breaking the law. If you had a custody order from the court and she refused to turn him over to you during your parenting time then she could get picked up for contempt. Without that though it's a waiting game.

She can take him out of state without his permission because they don't have a custody order from the court. Until she stays in another state long enough to establish residency there she is not breaking the law. It sucks but that's just how it works. I went through this about 2 years ago with my ex.

my advise if you want full custody is to figure out a way to send her to prison or jail and get full custody she cant keep any form of custody if shes locked up just my 2 cents

From what I've found, for Georgia, if you show signs that you plan to stay there (moving all your belongings there, submitting a change of address with the usps, etc) it's 14 days.

all her stuff is here. shes stupid and left without it. she didnt want me to know she was leaving cause she knew id take the baby from her (exactly right tho lol) ive been slowly working on getting all her shit in a box and putting it in the garage till court to see if she claims it. if not i know of a local place that will buy all her clothes, purses, shoes, exc for cash so thats what ima do lol. shes already risking jail time so i dont have to find a way. i cant wait for court so i can see the judge all over her ass for leaving. im trying to charge her mom with kidnapping and my ex with child stealing. they can both go to jail together and "drop the soap" lol! my mom asked me the other day if i missed my ex and i said "HELL NO BUT I MISS MY SON!" im dating this girl currently that ive known for the past 7 years. we been wanting to date that whole time but never jumped on it but now we decided it was time. shes changed my whole perspective on life. made me enjoy my life for once (besides when i think of my son) i can honestly say besides the day my son was born i have never been this happy in the past 3 years. im tired of all these "kid" relationships. im ready to settle down and start my life off the right way. im really considering getting merried sometime in 2013.. with my ex i developed stage 1 hypertension and am now at risk of all kinds of shit including stroke! and im only 20 years old! like how bad is that. thats how stressed my ex made me. so ya, im really considering getting merried. who knows how long ima live for. everyday is a blessing and tomorrow is never promised

so she has been served in georgia. i found her and a adress. i saw pictures of my son (i was being nosey and snooping around facebook). he looks really sick. also saw she brought a new guy into my sons life and he is playing daddy. that extremely pisses me off. i want to email her cussing her out but when i filed for custody the courts also filed a restraining order. i could care less that my ex is with someone else cuz i am also with someone, the thing that pisses me off is he is acting like my sons father. dont know what i shoud do right now.
