need help! infant baby involved!

ok so about 5 days ago my baby mama took off with my son and she will not let me see him. its been 5 days now, im loosing my mind. i miss my son. i called the police and said she ran off with him and said she was going to the park and just never came back. long story short they were no help. i tried callling her to ask her where she took him and she wouldnt tell me. i finally found out where shes staying and wrote down the adress and the lp numbers of the cars that are the homeowners since they picked her up. i went to court and filed for custody. she has the birth cirtificate and his social security card. i have the paternity papers from the hospital wich she has no idea i have. my parents said they will get me a attorny to represent me in court. im wondering if it will be a waste of money and if i have a chance? right now where shes staying is a 3 bedroom apartment. in that apartment there is now 4 adults and 2 kids. (the mom, 2 daughters, my sons mom, my son, and some other baby) i live with my parents in a 4 bedroom house where my parents, my sister, me, and my son all have his own room. i dont even know where my son is sleeping in that house. my sons mom is severly depressed all the time and has been for 3 years now, shes threatened to commit suicide twice, shes tried to enroll heself in a in patient center and is seeing a therapist. i told the police all that info as well and they said they wont do anything about it. im seriously worried for my sons safety. also i have a bank account that im the PRIMARY on and she is just on it as another person. she ran off with one of the cards to the account. im expecting a check in the mail from when i moved out of my apartment wich i was the primary on as well but her name was still on the apartment. will the bank cash it for me if i show ID and tell them that she ran off one day and never came back and idk where she went? i never been in this situation before and need advice

I've been there so I know what you're going through. Only real difference is my ex took off to the other side of the country with my son. If she doesn't leave the state she's not breaking the law. All you can do is go to court and fight for custody. If you can get any documentation that she tried to admit herself for inpatient psychiatric help you will want that for court. As for where she's staying, you could always go to the apartment office and let them know that all those people are living there but if she gets kicked out you may not find out where she goes so I would probably just let that be so you can keep tabs on her and your son. I don't know that I would hire an attorney right now but at least go talk to some, not just one, and see what they can do for you. Most of all, stay calm, don't make any threats or do anything stupid or it will fuck you in court. Courts tend to side with women for the most part in these matters so you have to play smart. Let her make an ass of herself and things will most likely work out in your favor. As for the bank thing, I don't think you can take her off the account without her signing off on it but I would go talk to the bank manager. Explain to them that she took off and say you don't know where she went. Ask them if you can get her off the account so she doesn't clear it out on you or just close the account and open a new one. With the check, you may be screwed if it says "and" between your names because you would either have to forge her name (I DON'T SUGGEST DOING THIS) or get her to sign it. Maybe go to the apartments and tell them she took off and see if they will print a check with just your name. If you have any more questions or need someone to talk to pm me. It's a long shot but go to court and file for emergency temporary custody if the child

Is in harm or could be. Generally most judges won't approve them but it's worth a shot. Also judges won't grant full custody to either parent they like for you guys to work it out. They'll even schedule mediator to sit with you two to talk it out. So if you know your child is or will be in harms way you better start getting your evidence yesterday

Thanks for the advice guys. Im keeping tabs on her and i think ima put the check in the account and then withdraw the money at like 12am before she gets to it. I dont want to loose the money cuz its 300 bucks lol.

Your best bet man is to lay back a lil bit... Keep tabs on her and SEE if she fucks up somewhere along the lines.. I will let you know that it is EXTREMELY hard to get custody taken away from the mother... I am currently going through the same shit with my ex wife... The only thing going in my favor is that I got CPS involved and they did a formal investigation... They went back to do a 2nd check up but my ex had moved away so right now I am saving money for an attorney

sorry for not responding lately been busy at court and shit. well i filed all the papers on my end. my mom got a call from my sons moms aunt and she said that my sons moms mom drove from georgia and picked up my son and my ex. i called the police department in georgia to file a kidnapping since right now we both have 50/50 custody and she is not authorised to take the baby out of state without my writen concent and they said to call the police department in my area and file it with them and they will fax it to georgia and then go from there on the charges being placed and me getting my son back to me in california. i know that now her mom is a accessory to all of this but isnt her aunt also a accessory for housing them until her mom came and got her? obviously she knew what the plan was? i called a attourney and he said we need to hop on this right now and file more papers for a emergency hearing that will force her to come back to california with the baby. my new girlfriends mom works for the state and said that the police department should put a nationwide warrent for my exes arrest.. i really dont know how someone could be so cruel and take a baby from his father. i have the birth cirtificate and paternity papers from the hospital. should i email her and tell her she has (x) amount of days to return with the child before i press charges or should i just press them anyway?
