Evan_P Posted March 2, 2016 Report Posted March 2, 2016 Need some advice here. I'll start this off by saying I was not the one involved, however it was my brother and he was driving my truck. From what He has told me a lady made a last second dive to get off the freeway from the left lane. While doing so she was on her brakes hard, He was in the right lane and when she come over in front of him he could not stop in time. In the end he rear ended her. Upon pulling over they exchanged contact info but not insurance and she told him that if he was ok, she was ok. They both left, no police, no report and pictures. This was nearly 2 weeks ago. Today she contacted him and now wants some cash to fix her car, and makes it clear she wants insurance out of it. She is currently only asking for $250 to help fix the vehicle. Not wanting to make the situation any worse, my brother is considering just paying what she is asking for. The issue here though is if he pays her what she is asking for, what is stopping her from trying to come after him later? What can he do? Should he even pay her? He asked me being concerned for my insurance rates, but I don't know what to tell him. I am not worried about my truck in any way. It took a $6 license plate bracket to fix it back to the condition before the accident. If this is the wrong place for this, feel free to move or delete it mods.
Miguels Posted March 2, 2016 Report Posted March 2, 2016 i wouldnt pay, it was her fault.. but if he does give her money make her sign a paper with her agreeing to settle the case did her car have damages? my logshttp://www.stevemead...-my-new-set-up/my blow through loghttp://www.stevemead...future-updates/ 96 ss http://www.stevemeadedesigns.com/board/topic/164094-96-impala-ss-build/
Evan_P Posted March 2, 2016 Author Report Posted March 2, 2016 It did, but he didnt get pictures of the damage. She is claiming it needs both taillights and the trunk no longer opens. The car in question is a 1983 Accord.
OrionStang Posted March 2, 2016 Report Posted March 2, 2016 Don't give her shit. Call your insurance and see what they say. SMD Super Seller My Feedback Thread
Miguels Posted March 2, 2016 Report Posted March 2, 2016 just remind her about her saying if he was okay she was okay.. if she still on it then tell her no money is coming out of your pockets and will be calling the insurance.. it was her fault so is either walk away with what they agreed to or she can pay more on her policy since she will be found at fault.. that simple. tell her to pay her own repairs with the money she will save by not making her policy more expensive my logshttp://www.stevemead...-my-new-set-up/my blow through loghttp://www.stevemead...future-updates/ 96 ss http://www.stevemeadedesigns.com/board/topic/164094-96-impala-ss-build/
Evan_P Posted March 2, 2016 Author Report Posted March 2, 2016 I am going to contact my insurance rep tomorrow and see what she recommends. I dont want him to pay her if he doesnt have to.
_paralyzed_ Posted March 2, 2016 Report Posted March 2, 2016 Tell her to get fucked. She lost any legal ground to stand on the second she drove away without a police report.
bcpballer64 Posted March 2, 2016 Report Posted March 2, 2016 If she wants no insurance involved I bet she doesn't have any, I'd call your insurance and tell her to get fucked otherwise, and as far as police report idk about your state but in indiana it's like $500 in damage or less doesn't need a report, iirc something like that "The strongest reason for people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government." -- (Thomas Jefferson)

I'm saying if she would try to take it to court she has no proof who did it or when it happened. It would be on the brother to admit those things. I would just ignore her until she goes away.
MADVIBES Posted March 2, 2016 Report Posted March 2, 2016 If she wanted to keep insurance out of it she does not have any, I agree. She was at fault but its your word vs hers since you have no witnesses and no police report to back it up. Its a shakedown. She is trying to get money. Tell her when she calls back you dont feel comfortable with the situation and you would like to get your insurance involved. remember in most cases if you pay money, you admit fault, could be her end game in a law suit. Dont pay get your insurance involved.. Also calling and asking your insurance what to do is the same as reporting it, They have to take action. Yes, your rates may go up if she does actually have insurance and lies about how the accident even took place. its an 83 accord lets be real, she more than likely does meth!
