When it comes down to it, no matter how small whatever being taken is, stealing is stealing. If I steal a 5 cent pack of gum from walmart, I can still get a shoplifting ticket. Now, yes, pretty much everyone is guilty of doing this online, hotlinking and whatnot, but they didn't just hotlink it, they hotlinked it AND tried to make it a part of their site, and that's where the thievery began. In the end it wouldn't have been that hard to ask if he could use it, and if told yes, to download the image and upload it to his site. Regardless of whether or not he did it, it being on his site makes him responsible.
