Aplogize for not being able to refund the money but, if he wants to find a buyer for you to make up the difference they lost on the deposit plus the original amount you were asking for, be wiling to work with them. Is this a restore or modification of the vehicle. If its a restore then just do that. if you gonna start making modifications then the list never ends. Along with the engine your gonna need a tranny. Then suspension is not gonna be good enough and so on and so on.

I had the same situation last year with a car I sold. It is so crucial to keep files on all vehicles you sell for at least five years just because of this. Well to make a long story short I went to court (locally) and came up with a date I sold the vehicle placing it back at least three years. The Judge laughed and dismissed the case and all the fees. Contact the court and try to prodcuce a Bill of Sale.
