Not to get sidetracked here but I think you might want to do a lit more of this "educating" you speak of. You talk about how people are posting whether or not he has a case when the thread clearly states that is what he is asking. Then because the first logical error wasn't enough, you went ahead to provide your personal opinion as to why he has a case. Not to mention your pearl of wisdom stating people shouldn't take to heart the things they hear as you DO THE EXACT SAME THING. A detective, if that's even true, isn't a professor on law. Do you ask your barber how to landscape your backyard? I was taken to court because of a dog killed on my property. I have 1 beware of dog sign and no no trespassing signs. Guess what....I won the case. The dog had jumped over a truck to get into my yard and was consequently attacked. He died days later from a blood clot traveling his veins and I feel bad for the owner and their dog. Bottom line being...my yard IS NOT public property. With, or without a private property sign. OP, like I stated you have my sympathy. But the way I see it, regardless of the reason you chose to enter his property. The actions and consequences thereof are sad but not 100% the neighbors fault. If your dog escaped (regardless of the damage to the fence) and roamed the streets, you would be held liable. Same in this situation. Tell me...does this smell like chloroform to you?

How tall is the fence? What kind of dog does the neighbor have? Did you pay to have the fence built? What kind of dog do you have?? I also agree with what the dude above me said..

With, or without a private property sign. you have a sign... i said if you have ANY sign saying your yard is prohibited then its not your fault if something comes into your yard, and you did win the case proving my point.... so your story doesnt do anything besides give evidence that this is true also yes i did talk to a detective that told me that but i also knew this partly before i asked the other guy claimed you can shoot someone when they are running away from your property and get away with it. which you cant do that it would be considered man slaughter. Who in there right mind tries to break up a dog fight with large dogs? At least one large dog anyways. Use a stick or something to shove between them. You didn't notice the hole at all? IMO you should always check your yard every now and then. Derp.

Dougs dog doesn't know any better to not crawl through the hole, he's a dog! Like any loving pet owner would do, Doug jumped over to save his dog from the attacking dog, the same dog who dug the hole into dougs yard. yeah, neighbors dog dug a hole under said neighbors fence. OP should have had his own containment for his dog, instead of relying on the neighbors fence to contain HIS dog. Owner of BigAss Ports

This is where common logic will help you bro. A beware of dog sign is not a prohibited area sign. Completely different things. And my victory in the case doesn't prove your point in the least. The reason I won was not because of the sign on my property. I won because the dog had entered my property and therefore I was not liable for the actions of my dog. The hole dug allegedly by the neighbors dog would have to be proved before that story makes any sense. According the doug, he's never seen the hole. Yet he knows for a fact it was the other dog and not his own that dug the hole? You and your "detective" friend sure could use some lessons in detective work. But I see all this as a mute point, because it will not change the fact the owner and his dog stepped on someone else's property. You're expecting the dog to have the intellectual freedom to separate a curious dog and his protective owner from a burglar. Think about it. Both the owner and dog stepped onto someone else's property and did so at their own risk. If the hole was such an issue I would assume the neighbors dog who allegedly dug the hole would have used it to get out and wreak havoc the way the OP states it would. Instead, your reasoning is because the dog dug the hole and waited like an intelligent predator for an unexpecting curious dog to use it and the owner didn't have signs and his yard is public property he is responsible. Please use logic when responding... Tell me...does this smell like chloroform to you?
