The company initially says that they can and they charge the customer for it. A couple weeks goes by and the company says that for whatever reason, the product could not be had or serviced. At that point the company issues a refund to the customer. Customer may be mad or w/e but has their money back regardless. Now my buddy feels as if this is illegal, idk what his thoughts behind it really are...something about false advertising or something. I think it's perfectly legal and that the situation might just suck for the customer.. What are your thoughts? And has this happened to anyone? If it was illegal companies left, right and centre would be getting fined. You offer the exchange of money in return for goods or services. Advertised or not, if a company or individual cannot hold up their end of the contract by supplying that good or service, then the contract is null and void and your monetary investment is due back to you as if a transaction never occurred in the first place. False advertising is different. That is when you enter into that contract by agreeing to pay money for a certain good or service in a certain condition, and the good or service supplied to you is significantly different to what you agreed upon. Example - A fast food joint releases a commercial and signage offering an Angus burger for 1$. You go to said establishment, order that item, hand over your 1$ and receive a turkey burger flavored to taste like Angus beef.
