And even if her passengers made a statement, they are biased witnesses. You can tell he knew who he was going to side with from the beginning. He didn't even write down my statement accurately. I sent a statement of corrections with the accident report to my agent, and called her to let her know of my concerns. They got my back, which I truly appreciate. I was glad that I had a good insurance company when I got in a minor rear-end accident (my fault). I rear ended a ford explorer at less than 10mph and the only damage to their vehicle was a cracked rear bumper and a small dent on the rear lift gate. My truck had a bent front bumper and broken motor mount which made my motor shift and it sheared off my oil filter. We exchanged insurance info, the CHP took the reports and we were in our way. 2 weeks later, I got served with lawsuit papers...I was being sued for $280,000! And I even admitted fault in the police report. The fact alone that there aren't any unbiased witnesses should be enough to no be liable for anything. Back in November, I was starting to pull out of my schools parking lot at lunch(key thing here is my truck DID NOT exit the parking lot), and this chick in a Slugbug swerved across the road HAULING ASS, hit a curb and her car caught air as in a good 2 feet off the ground, and flew into a tree. On the police report, I was noted as a contributing factor seeing as my truck did not enter the road way. So now, almost 8 months later, her insurance company is attempting to sue me for close to $30 grand saying I was 70% the cause of the accident. The cop I talked to that handled the accident didn't ticket me or anything, and no witnesses were noted on the police report....so the cop told me that I'm "Pretty much in the clear," the day of the accident. The really fucked up thing out of the deal, is the chick who wrecked didn't even blame it on me. She said my chrome bumper reflected and scared her a little bit, but her brakes didn't work after she hit the gas instead of the brake pedal. Whole crazy ass ordeal... But yeah, some cops are cool like the one I had, then there are the biased assholes like Ken is dealing with... Best of luck to you Ken.
