IF he does pay, make sure you get a written contract saying it was to fully settle the accident between them on that day. When you pay you are admitting guilt.

Sucks, happened to me, a box truck cut over from the far left to make a right turn in front of me. I got the ticket for rear ending even though i explained to the officer exactly what happened. At this point, call insurance and let them work it out. Expect your rates to increase. Don't know about others but around here police dispatch often won't even send an officer if it's a small accident, they'll just tell people to exchange insurance and deal with it that way. Also you are not automatically at fault just because you hit someone from behind. Sometimes you might get fucked but I've seen it go both ways.
