Legal issue with my dog being attacked.

Jumping a fence to save a dogs life and being attacked by the same dog does not absolve the homeowner from responsibility of the dogs actions. That homeowner is liable for everything the dog does whether its in the yard or outside the yard, just cause you have a sign that says beware of dog doesn't mean your dog can kill, injure or maim other animals or people and leave you not responsible for what they do.

That is true, but what I'm getting at is that most lawyers can make this into a good case. He wasn't just trespassing on their property, he was rescuing his dog.

Oh and to the OP, I feel like you have a really REALLY good case so I would take them to court ASAP.

Only downside to the whole thing, for the dog/animal lovers, is that the attacking dog will most likly get "put to sleep"

My sympathy, but I don't see too much of a case. I own two pitbulls and I've had dogs come into my yard and have been seriously injured and one was killed. I don't brag about the fact, but my dogs are not here for petting. And unfortunately on their property is a hard case to win.

well, YOUR dog was in THEIR yard. YOU were in THEIR yard, which is how a lawyer will look at it. im mixed on it at this point.

so, you jump over someones fence knowing damn well you are probably about to get hurt, and the liability falls on the person who has the fence to keep other people out........ nice logic.

they may be able to turn it into a profitable case, but never a good case. excuse me, im gonna go to mcdonalds now, and while im there, im gonna order a hot cup of coffee, and despite all the warnings printed on the cup, im gonna spill it on myself, and then sue them. brb.........

idk why everyone is arguing that he has a case or not....For one he would have a case, the neighbors dog dug a hole onto his property and damaged his fence...he could sue for that, he could also sue that since their dog ruined part of his fence his dog went into their yard (their fault) and their dog attacked his. he never said they had beware of dog signs or anything like that so it doesnt matter what goes wrong their dog was at fault for hurting his period .........Thats why those signs and no trespassing signs are made for legal issues.

think about it this way if someone has a pool and a privacy fence and a kid climbs over and drowns thats his fault and cant sue for that ......but if you dont have a fence or a part of the fence is open and a kid drowns its the home owners fault and can be sued

in this case part of the fence was taken out but the neighbors dog and his dog went under...... its the neighbors fault

EDIT: if the homeowner didnt have no trespassing signs(also i think you have to have one on each side of the fence to be visible to everyone) or beware of dogs, and op was attacked its the homeowners fault
